On 30 December 2020, the Society for Threatened Peoples – Gesellschaft für bedrohte Völker (GfbV), representing indigenous peoples - Indígena Pataxó e Pataxó Hã-Hã-Hãe, submitted a specific instance alleging that a German multinational enterprise in the industrial sector had not observed the General Policies (Chapter II), Disclosure (Chapter III), Human Rights (Chapter IV), and Employment and Industrial Relations (Chapter V) provisions of the Guidelines.

A similar case was brought to the German NCP as the location of the company headquarters. The Brazilian and German NCPs cordinated on the case for the first half of 2021. On 17 March 2021, the Brazilian NCP decided to accept the case for further consideration, however, on 29 June 2021, the submitter requested the closure of the case with the Brazil NCP, opting to have the case handled soley by the German NCP.

On 9 August 2021, the Brazil NCP published a final statement concluding the specific instance procedure with their NCP.
