On 15 March 2021, two individuals submitted a specific instance to the Canadian NCP alleging that, between 2010 and 2015, B2Gold, a Canadian mining company, had not observed the Concepts and Principles (Chapter I), General Policies (Chapter II), Disclosure (Chapter III), Human Rights (Chapter IV), and Environment (Chapter VI) provisions of the Guidelines. Specifically, issues related to alleged illegal mining activities on private property involving, trespassing and illegal exploitation of a mining concession, illegal extraction of ore from the surface of the property of one of the notifiers’, failure to undertake the environmental remediation of a sinkhole created by the company’s underground exploitation under the land of one of the notifiers.

On 15 June 2021, the NCP published its initial assessment deciding not to accept the case as the allegations had not been sufficiently substantiated by the notifiers.
