On 1 December 2020, an individual, Mr. Teumagnie, submitted a specific instance to the French NCP alleging that the French Group ASCOMA International, a subsidiary of a Cameroonian health insurance company, had not observed the Consumer interests (Chapter VIII) provisions of the OECD Guidelines. More specifically, the submitter contested the refusal of reimbursement of medical expenses that he initiated in France in 2017 and in 2018 and submitted a request for financial compensation to the French NCP on the grounds that the French company ASCOMA International “would represent" the ASCOMA Group.


On 15 December 2020, the French NCP began its initial assessment, noting that the specific instance did not meet the initial assessment criteria and expressed doubts about the good faith of the referral. The French NCP accepted that ASCOMA International maintains a business relationship within the meaning of the Guidelines with ASCOMA Group, but concluded that there was no substantial link between the complainant’s claim and the Guidelines as the case was related to a personal dispute. The French NCP nevertheless facilitated a dialogue between the submitter and the company that did not, however, result in an agreement between the parties.

Accordingly, the French NCP closed the procedure and adopted an its initial assessment statement on 6 April 2021 deciding not to accept the case.
