On 15 October 2016, an individual submitted a specific instance to the Italian NCP regarding an Italian bank, and other relevant individuals following the foreclosure of his house due to a non-payment of credits claimed by the bank.

The submitter stated that the judge had approved the foreclosure and the forced sale in spite of the actions of the bank, and that that the bank had not observed the Guidelines along with several Italian laws and regulations, the European Convention on Human Rights (ECHR) and the Universal Declaration of Human Rights.

After assessing both the specific instance and the documents submitted, the Italian NCP concluded that the issue raised does not merit further examination because of the following reasons:

  • The issue raised, including the alleged expropriation of the submitter’s house is still pending in judicial proceedings;
  • With regards to the individuals involved, the instance is inadmissible because they are not covered by the scope of the Guidelines;
  • The issue brought against the bank is not sufficiently substantiated;
  • Further examination of the issues raised would not contribute in any way to the purpose and effectiveness of the Guidelines.
