On 21 October 2020, an individual (Mónica Cabariti) submitted a specific instance to the Argentine NCP (ANCP) alleging that Arca Continental, the second largest bottling company active in the production, distribution and sale of non-alcoholic drinks by The Coca-Cola Company brands in Latin America, had not observed the General Policies (Chapter II), Disclosure (Chapter III) and Environment (Chapter VI) provisions of the Guidelines. Specifically, the issues raised included a failure by the company to disclose information relating to the environmental and social impacts of its operations, and failure to comply with its own Code of Ethics.

On 21 January 2021, the NCP completed an initial assessment deciding to accept the case for further examination. The NCP made an offer of good offices to the parties, which after several exchanges of information to clarify the facts of the specific instance, the company did not accept. The company nevertheless thanked the NCP for its cooperation and invitation to participate in the procedure. The company indicated feeling that it had already proved its compliance with all legal and regulatory provisions relating to environmental management.

On 28 April 2021, the NCP published a final statement officially concluding the procedure without an agreement between the parties. The NCP encouraged the parties to consider the necessary conditions to engage in dialogue and work constructively together. The NCP additionally called on all MNEs to adopt codes of conduct that identified, prevented, and mitigated risks related to company actions. The NCP did not report any plans for a follow up but noted it would remain available to the parties for any future inquiry.
