Summary

On 23 August 2017, a pension fund, Postalis Instituto de Previdência Complementar (Postalis), and two trade unions, Sindicato dos Trabalhadores na Empresa Brasileira de Correios e Telégrafos no Estado do Tocantins and Federação Interestadual dos Sindicatos dos Trabalhdores e Trabalhadoras dos Correios (FINDECT) submitted a specific instance to the Brazilian NCP alleging that an american multinational company specialised in financial and insurance activities did not observe the OECD Guidelines. More specifically, the submitters alleged that the company had committed fraud and other improprieties in the administration of pension funds in Brazil.


As the company originated from the US, the Brazilian NCP informed the US NCP of the specific instance.

However, the submission that was presented to the NCP was incomplete, lacking, among other issues, the specification of the breaches of the OECD Guidelines.

Despite several attempts of contact by the Brazilian NCP in 2017 and 2018, the submitters did not provide the requested information.

Hence, on 13 August 2020, the Brazilian NCP decided not to accept the case and to conclude the specific instance.
