On 27 January 2020, a group of Chilean creditors represented by a law firm, submitted a specific instance to the Canadian NCP alleging that SNC Lavalin and SNC Lavalin Chile, its Chilean engineering and construction subsidiary, had not observed the Human Rights (Chapter IV) and Employment and Industrial Relations (Chapter V) provisions of the Guidelines. This case was transferred from the Chilean NCP to the Canadian NCP in January of 2020. Specifically, issues relate to an alleged plan by the subsidiary to transfer profits back to the parent company, allowing its subsidiary to become insolvent and thus defraud creditors.

On 11 June 2021, the NCP made the decision not to accept the case without being able to perform a formal initial assessment. This was due to the fact that, after multiple requests, the submitters failed to provide additional information to substantiate their submission.
