On 6 June 2019, workers and the trade union of a contractor company to Telefónica submitted a specific instance to the Chilean NCP alleging that Telefónica had not observed the Human Rights (Chapter IV) and Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, the issues concerned the sudden lay-off of workers due to the end of the business relation between the contractor company and Telefónica, by unilateral decision of the contractor company.

The NCP began an initial assessment but noted that the submitters had become unresponsive.

On 25 August 2023, the NCP published a final statement deciding to conclude the procedure without agreement between parties. The NCP addressed the following recommendations to the enterprise:

  • Adopt and implement risk-based due diligence
  • Encourage that its business partners apply standards of RBC and implement due diligence processes
  • Strive to prevent and mitigate adverse impacts on the rights of workers
  • Monitor the respect of labour rights by the subcontractors with which it works and use its influence to promote this respect.
