On 3 August 2020, a group of relatives of a worker of a contractor company of Complejo Metalúrgico Altonorte S.A., an enterprise owned by Glencore, a Swiss multinational commodity trading and mining company, submitted a specific instance to the Chilean NCP alleging that Complejo Metalúrgico Altonorte S.A. and Glencore had not observed the Human Rights (Chapter IV) and Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, the issues concerned the death of a worker in the workplace, the related alleged lack of occupational safety, and regulations and training for workers at the contractor company, and an alleged lack of due diligence by Glencore.

On 8 April 2021, while the Chilean NCP was still performing its initial assessment, the submitters informed that they would be withdrawing from the procedure due to an agreement reached with the company outside of the NCP process.

On 3 May 2023, the NCP published its final statement concluding the case with agreement between the parties outside of the NCP process.

The NCP issued the following recommendations to Glencore:

  • Implement risk-based due diligence processes in accordance with the Guidelines and related due diligence guidance
  • Encourage business partners and value chain to implement risk-based due diligence processes and principles of RBC
  • Maintain appropriate practices and protocols to ensure the health and safety of the people on its premises, or those that may be impacted by its operations regardless of the existence of a commercial or legal link with the company.

The NCP issued the following recommendations to the workers of Glencore and its subcontractors:

  • Promote and participate in the risk-based due diligence process in good faith and in an active manner
  • Strictly observe the practices and protocols relating to occupational safety
  • Demand the maintenance of these practices and protocols.

With the final statement, the NCP considers the case concluded and has not noted plans for follow up.
