On 21 October 2020, the trade union of Tecnet and Unitary Confederation of Workers (CUT) submitted a specific instance to the Chilean NCP alleging that Tecnet S.A., the Chilean subsidiary of Ezentis, a Spanish group active in the operation and maintenance of telecommunications and energy networks, had not observed the General Policies (Chapter II), Human Rights (Chapter IV) and Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, the issues concerned anti-union practices against workers and the non-payment of health and social security contributions and social credits.

While the initial assessment was ongoing, the company informed the NCP that it was not willing to participate in the process, therefore the NCP moved immediately to the conclusion phase. Parallel proceedings were ongoing concerning issues raised in the specific instance.

On 27 July 2023, the NCP published a final statement concluding the procedure without an agreement between the Parties. The NCP issued recommendations to the company, notably, to respect national laws and other legal norms and international treaties in force in Chile, to maintain a public policy commitment to protect human rights, and to respect the rights of workers to form and join trade unions of their choice, including for the purpose of collective bargaining.
