Summary | Read the Final Statement published 24 May 2023: English On 17 October 2020, the Daphne Caruana Galizia Foundation, a Maltese NGO, submitted a specific instance to the German NCP alleging that Siemens AG, a large technology company focused on industry, infrastructure, transport and healthcare, had not observed the General Policies (Chapter II), Human Rights (Chapter IV), Combating Bribery, Bribe Solicitations and Extortion (Chapter VII), and Taxation (Chapter XI) provisions of the Guidelines. The issues raised concern events related to the ElectroGas Malta consortium, in which the company’s fully-owned subsidiary, Siemens Project Venture GmbH (SPV) is a minority shareholder. Further details about the issues were not made publicly available. The German NCP completed its initial assessment on 31 December 2021, deciding to accept the case, as it related to Chapters VII and XI of the Guidelines, for further examination. The NCP did not accept to examine the allegations relating to Chapter IV. The NCP offered its good offices to the parties, which they both accepted. Following mediation conducted by an external mediator, the parties reached agreement. The agreement, which seeks to further the implementation of the Guidelines, was kept confidential as agreed by the parties.
