Summary | Read the Final Statement published by the NCP 15 December 2022: French On 21 December, 2021 Intersyndicale ATOS (trade union) submitted a specific instance to the French NCP alleging that ATOS, a digital services company, did not observe the Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, ATOS ESU had allegedly made a unilateral decision to abolish a social and economic committee, considered by the Union to be contrary to the freedom of representation and collective bargaining of workers. The parties had engaged in parallel proceedings relating to the issues, but had not been able to come to a resolution. On 3 January 2022, the NCP completed its initial assessment determining that the issues raised merited further consideration. The NCP moved to offer its good offices, which both parties accepted. On June 1, 2022 the NCP conducted a mediation meeting with Atos and the inter-union in a respectful and constructive atmosphere. The mediation meeting allowed the parties to converge on several points resolving all the issues raised by the specific instance. The agreement notably included the restoration of the lost committee, a commitment from the parties to respect social dialogue, and an agreement by the parties not to pursue the same issues in another judicial or non-judicial process. The NCP will invite the parties to communicate updates on the implementation of the agreements 12 months after the publication of the final statement. |
