Summary | Read the initial assessment published 13 August 2021: English Read the intermediary statement published 14 July 2022: English Read the final statement published 27 June 2023: English Read the follow up statement published 27 October 2023: English On 21 September 2018, the Irish NCP received a specific instance from IUF, a global union federation, alleging that The Coca Cola Company, active in the food and beverages sector, specifically its wholly owned franchised bottling operation in Ballina, Co. Mayo, Ireland - Ballina Beverages, had not observed the General Policies (Chapter II), Human Rights (Chapter IV), and Employment and Industrial Relations (Chapter V) provision of the Guidelines. Specifically, the issues related to the right to form and join Unions, right to representation by Unions for collective bargaining, and commitments to provide effective whistleblowing. On 13 August 2021, the Irish NCP published an initial assessment statement deciding to accept the case for further examination. The NCP offered good offices and mediation to the parties, which they both accepted. The parties entered into mediation and agreed to adjourn and re-engage following the publication of a report on the industrial relations landscape in Ireland, or by June 2023 at the latest (see the report, published Q4 2022). The NCP published an intermediary statement as an update following this first round of mediation. The parties re-engaged in April 2023 and reached a confidential agreement. The NCP published a final statement on 27 June 2023, concluding the NCP procedure. The NCP recommended that the parties follow through on the actions identified in the confidential agreement. The NCP recommended that the IUF and The Coca-Cola Company continue to work together outside the NCP process, maintaining and building on their long-standing relationship. On 27 October 2023, the NCP published a follow up statement. The NCP noted that whilst both parties engaged actively and constructively with the NCP process at every stage, aspects of the complaint remained unresolved.
