Summary | Read the Final Statement published 5 February 2024: English | Japanese On 4 and 5 November 2021, Mr. Ananda Subasinghe submitted a specific instance to the Japanese NCP alleging that Noritake Company Limited, a Japanese tableware and technology company, and its Sri Lankan subsidiary, Noritake Lanka Porcelain Limited had not observed the Concepts and Principles (Chapter I), General Policies (Chapter II), Disclosure (Chapter III), Human Rights (Chapter IV), Employment and Industrial Relations (Chapter V) and Consumer Interests (Chapter VIII) provisions of the Guidelines. Specifically, issues related to the dismissal of the submitter from the abovementioned enterprises in June 2021. The submitter alleged that this dismissal was discriminatory and due to him having made a good faith report of corporate activity in violation of law, the Guidelines or corporate policy. The submitter requested that the NCP conduct fact-finding and assessments regarding the issues raised and take appropriate measures, including helping the submitter to obtain monetary compensation. On 5 February 2024, the Japanese NCP published a final statement deciding not to accept the case for further examination. The decision was made due to ongoing parallel proceedings in the Labour Tribunal of Sri Lanka, the lack of clarity around the interests of the submitter, and the NCP’s conclusion that the handling of the case would not contribute to the purpose and effectiveness of the Guidelines.
