Summary | Read the Initial Assessment published 15 January 2024: English On 1 December 2022, the Industrial Trade Union of Mechanical Engineers submitted a specific instance to the NCP of Kazakhstan alleging that LLP «Alstom Kazakhstan», the Kazakhstan country office of the French manufacturing company Alstom, had not observed the Human Rights (Chapter IV) or Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, the submitters alleged that the company had violated the terms of an Industry Agreement in accordance with Kazakhstan national legislation on the rights of trade unions, and demanded the signing of a collective agreement in accordance with the Industry Agreement. Parallel proceedings were ongoing with the company and submitter in accordance with national law. On 15 January 2024, the NCP published an initial assessment deciding that the specific instance merited further examination and would move to good offices. The company notified the NCP that it had paid the submitter the amount owed under the terms of the Industry Agreement following the court decision reached on 2 October 2023, and therefore considered the issues resolved. Nevertheless, the NCP sent an offer to organise joint negotiations to discuss other matters raised in the specific instance, which the company declined. On 18 July 2024, the NCP published a final statement concluding the specific instance without agreement between parties.
