Summary | Read the initial assessment, published 22 July 2021: English Read the final statement, published 22 March 2023: English On 22 February 2021, FNV, the largest trade union in the Netherlands, alleged that 10bis, an Israeli subsidiary of JustEatTakeaway.com, had not observed the Concepts and Principles (Chapter I), General Policies (Chapter II), Human Rights (Chapter IV), and Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, the issue concerns the due diligence practices of Just Eat Takeaway.com as a parent company for the actions of their subsidiaries, in this case 10bis, and the right of workers to organize themselves in a trade union. The case was sent also to the Israeli NCP regarding the involvement of 10bis Ltd (or Scoober, according to Just Eat Takeaway.com). The NCPs of the Netherlands and Israel decided to handle the cases separately, but coordinate their actions. On 22 July 2021, the Dutch NCP published the initial assessment accepting the case for further examination, offering the parties its good offices, which FNV accepted. JustEatTakeaway.com did not accept the offer of good offices. On 22 March 2023, the Dutch NCP published its final statement determining that JustEatTakeaway.com has acted in a manner that is not consistent with the OECD Guidelines. The NCP recommends that JustEatTakeaway.com ensure that 10bis/Scoober enters into meaningful social dialogue with Histadrut (the Israeli trade union), communicate to all workers of 10bis/Scoober that they can join a trade union of their own choosing, and enter into a dialogue with FNV regarding its due diligence responsibilities as the parent company. With this publication, the NCP procedure is concluded. The NCP will conduct a follow up on the implementation of the recommendations one year after publication of the final statement. |
