Read the Final Statement published by the NCP on 22 February 2023: Dutch


On 10 March 2022, the Dutch NCP received a specific instance submission from two Dutch trade unions, FNV and CNV, concerning an alleged violation of the Human Rights (Chapter IV) and Employment and Industrial Relations (Chapter V) provisions of the Guidelines by flower auction Plantion and Dutch flower auctions association VBN. Specifically, according to the notifying parties, Plantion excluded them from taking part in the negotiations concerning a new collective bargaining agreement. By doing this, Plantion acted (according to the notifying parties) against the right of workers to join trade unions and representative organisations of their own choosing, including for the purpose of collective bargaining.

On 22 February 2023, the NCP published a final statement deciding not to accept the specific instance for further examination. The NCP made the decision as the complaint lacked an international component and the NCP considered it was not the right entity to address the issues raised. With the final statement, the NCP considers the procedures closed.
