On 5 May 2020, Muchtar B. Pakpahan, in his capacity as chairman of the Dewan Pengurus Pusat (Konfederasi) Serikat Buruh Sejahtera Indonesia ((K)SBSI), a trade union confederation in Indonesia, submitted a specific instance to the Dutch NCP alleging that CNV, a Dutch trade union, had not observed the Guidelines. Chapters were not specified.

The submitters alleged that CNV had been illegally cooperating with and funding another trade union in Indonesia, which had a similar name to the submitting party. The submitting parties requested that CNV either stop cooperating with and funding the other Indonesian trade union, or ensure that it uses a different acronym.

On 28 September 2022, the Dutch NCP published a final statement deciding not to accept the case for further examination. The NCP made this decision on the basis that the submission did not make reference to any provisions in the Guidelines, issues could not be considered material or substantiated, and CNV is not an MNE under the Guidelines. The NCP considered that handling the specific instance would not contribute to the Guidelines’ objectives or increase their effectiveness.
