On 24 January 2024, VU Climate Change & Sustainability Law Clinic, North Sea Fossil Free, Scientists for Future NL, Scientist Rebellion NL and Deutsche Umwelthilfe submitted a specific instance to the Dutch NCP alleging that ONE-Dyas, a Dutch private limited liability company that is seeking to extract fossil gas from the North Sea, had not observed the General Policies (Chapter II), Disclosure (Chapter III), Human Rights (Chapter IV), Environment (Chapter VI), and Consumer Interests (Chapter VIII) provisions of the Guidelines. Specifically, the submitters argue that life-cycle greenhouse gas emissions caused by the fossil gas extraction will significantly harm human rights and the environment. The submitters allege that ONE-Dyas has failed to identify scope 3 emissions, which include emissions from transporting the gas and from its end use, in the project’s Environmental Impact Assessment. Moreover, they allege that ONE-Dyas should have assessed the human rights impacts of these scope 3 emissions. Finally, the submitters state that ONE-Dyas misrepresents the climate-related impacts of the project in its public communications.

On 11 October 2024, the NCP published an initial assessment deciding to accept the case for further examination. The NCP made an offer of good offices, which both parties accepted.
