On 29 June 2020, the Polish NCP received a notification of alleged breach of the OECD Guidelines for Multinational Enterprises.The notification was submitted by an individual, representing his family, which owns a residential property and land located in the immediate vicinity of the Grupa LOTOS S.A.

The Notifier specified that his family lived from 1945 to 1998 in a house in the vicinity of which, Grupa LOTOS S.A, an extractive sector company operating mainly in the fuel industry and in oil and gas production, built an oil refinery and a waste treatment plant in 1970. According to the submitter, the Company engaged in oil refining causing negative effects by polluting the air with toxic compounds, contaminating surface water, groundwater, and threat of industrial disaster.

The Polish NCP accepted the case for further examination on January 18, 2021 and agreed with the parties on a confidential Initial Assessment. The NCP made an offer of good offices, which both parties accepted.

The parties participated in meetings facilitated by the NCP and were able to reach a partial agreement on the issues discussed. The details of the agreement are confidential at the request of one of the parties. The NCP published a final statement on 7 March 2023, containing only basic information about the specific instance.

Due to the fact that the partial agreement reached by the parties covered issues outside the competence of the NCP there will be no follow-up of the case.
