Summary | Read the Initial Assessment adopted 31 October 2023: English | Polish On 22 January 2023, Mr. Krystian Kosowski, a former employee of SII Sp. z.o.o., a technology consulting, digital transformation, engineering, and business services vendor in Poland, submitted a specific instance alleging that the company had not observed the General Policies (Chapter II), Human Rights (Chapter IV), and Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, the submitter alleged that the company did not respect freedom of association, including the creation of trade unions, the system of employee remuneration, and the consideration of seniority. The submitter claimed that he was dismissed from work after establishing a trade union organisation within the company. On 28 August 2023, after holding meetings with both parties, the NCP decided to accept the case for further examination. The NCP also learned of several pending proceedings relating to the issues, including: proceedings before the district court for re-employment, criminal proceedings, court proceedings to determine the size of the newly formed trade union as well as inspections conducted by the State Labour Inspectorate and the Office for Personal Data Protection.
