Summary | Read the final statement published by the NCP 3 November 2023: English On 22 September 2021, the Federation of Somali Trade Unions (FESTU), the International Trade Union Confederation (ITUC) and International Transport Workers Federation (ITF) submitted a specific instance alleging that Favori LLC, a Turkish airport management and ground handling company and subsidiary of the Kozuva Group, had not observed the Concepts and Principles (Chapter I) and Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, the issues relate to the operation of the Mogadishu International Airport, and the refusal to recognise workers’ free choice of trade union and bargaining representative. Additionally, the submission raises a failure to observe Somalia’s national law on industrial relations. In the context of conducting an initial assessment, the NCP contacted both parties. The company clearly indicated a lack of willingness to participate in the NCP process and refused further communication. The NCP contacted TİKA - Turkish Cooperation and Coordination Agency (a government agency tasked with implementation and coordination of overseas development assistance) and the Ministry of Foreign Affairs on 12 October 2021 to seek any further information on the case, none was provided. The NCP contacted the submitter again on 23 January 2023 in relation to possible developments on the case. FESTU has not since responded to emails from the NCP. The NCP concluded that neither party showed interest in continuing the process, and therefore decided to conclude the case. |
