Summary

In May 2011, the US and Japanese NCPs received a request of review from an NGO alleging that a multinational enterprise had breached the general principles, disclosure, and environment provisions of the Guidelines through their mining exploration activities in the USA.

The NCPs evaluated the specific instance and determined the Guidelines did not pertain because the US firm was a solely domestic enterprise and the nature of the business relationship between the Japanese and US firms did not meet the conditions for application of the Guidelines.

A joint final statement concluding the specific instance was issued to parties by the Japanese and US NCPs.
