On 29 August 2018, International Union of Food, Agricultural, Hotel, Restaurant, Catering, Tobacco and Allied Workers’ Associations (IUF), an international trade union, submitted a specific instance to the US NCP alleging that Cargill Incorporated, a privately held American global food corporation, had not observed the Human Rights (Chapter IV) and Employment and Industrial Relations (Chapter V) provisions of the Guidelines. Specifically, issues related to conduct by Cargill through its operations in its Bursa-Orhangazi and Balıkesir facilities in Turkey. IUF asserted that employees were dismissed – allegedly because they exercised their freedom of association and chose to join a union and/or participate in union-related activities.

On 29 August 2019, the US NCP completed an initial assessment in which it decided to accept the specific instance for further consideration. The NCP offered mediation to begin its good offices phase and both parties accepted. The parties participated in multiple pre-mediation meetings but were unable to agree on an agenda of items to be discussed.

On 20 March 2020, the US NCP published a final statement deciding to close the case without agreement. This was due to an inability of the parties to agree on topics to begin mediation. The NCP recommends the parties to sustain a dialogue and extends a potential offer of mediation in the future should the companies wish to participate.
