Summary | Read the Final Statement published by the NCP 31 August 2021: English On 29 January 2020, Divest Invest Protect (DIP), Indigenous Peoples Law and Policy Program (IPLP), and Women’s Earth and Climate Action Network (WECAN), three NGOs, submitted a specific instance to the US NCP alleging that Credit Suisse Group, a banking group headquartered in Switzerland, had not observed the General Policies (Chapter II), Human Rights (Chapter IV), and Environment (Chapter VI) provisions of the Guidelines. Specifically, issues related to the Company’s alleged failure to leverage its business relationship, as a financing services provider, with the U.S.-headquartered Energy Transfer Partners (ETP) energy company to prevent or mitigate potential adverse impacts linked to the ongoing activities of ETP’s U.S.-based oil pipeline. On 31 August 2021, the US NCP published a final statement deciding not to accept the case for further consideration. This was due to an inability to link the business relationship to adverse impacts, and existence of a similar case previously handled by the Swiss NCP against the same company. The specific instance handled by the Swiss NCP had led to an agreement with the company regarding its business relationship with construction companies involved in the US-based oil pipeline. For these reasons, the US NCP determined that offering its good offices would not contribute to the purpose and effectiveness of the Guidelines in this instance. #contributed #directlylinked #riskmanagementsystem #remedy #duediligence #discrimination #civilandpoliticalrights #ESCR #indigenousrights #pollutionandwastemanagement #naturalresources #degradation #oilandgas #projectfinance #parallelproceedings #localsubsidiary #UNGPs #Internationalhumanrightstreaties #agreement |
